Who has to file one
A trustee appointed by a court, or named in a trust that does not waive bond. Corporate trustees — banks and licensed trust companies — are exempt in most states.
What it protects
The beneficiaries. If the trustee self-deals, misinvests in breach of duty, or fails to account, the bond covers the loss and the surety pursues the trustee for repayment.
How the amount is set
By statute or by the court, generally tied to the value of the trust property the trustee controls — several states set it above the asset value to cover income and costs.
