Appeal bonds.
Every state we write.

An appeal bond — also called a supersedeas bond — stays enforcement of a money judgment while you appeal it. Without one the winning party can begin collecting immediately, even with the appeal pending. These are underwritten rather than instant-issue, so the price comes back on review. Pick your state below for its requirement and the rule that sets the amount.

How it works

Appeal bonds, in plain terms

A stay on collection while the appeal runs its course.

Who posts one

The appellant — the party that lost at trial and is appealing a money judgment. Filing an appeal alone does not stop collection in most jurisdictions; the bond is what buys the stay.

What it guarantees

That the judgment, plus interest and costs, gets paid if the appeal fails. It protects the judgment creditor from the delay, which is the reason courts require it before granting a stay.

How the amount is set

By court rule or statute, typically the judgment plus an allowance for interest and costs accruing during the appeal — often 100% to 150% of the judgment. Several states cap it.
