What the bond actually guarantees

Arkansas licenses new (franchise) motor vehicle dealers through the Arkansas Motor Vehicle Commission, and conditions the license on a $50,000 surety bond. The bond is a consumer-and-public-protection guarantee: it stands behind your compliance with the Arkansas Motor Vehicle Commission Act and the customers and franchises you deal with.

It's a three-party arrangement: you (the principal), the surety carrier standing behind you, and the State of Arkansas together with harmed parties (the protected parties). If a dealer violates the Commission Act or fails to meet an obligation the bond backs, the harmed party can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. Dealers who follow the Commission Act and keep good records treat the bond as a license formality, not a risk.

A.C.A. 23-112-302 (Arkansas Motor Vehicle Commission)Arkansas new (franchise) motor vehicle dealers are licensed by the Arkansas Motor Vehicle Commission under the Arkansas Motor Vehicle Commission Act (A.C.A. 23-112-101 et seq.), which conditions the license on a $50,000 surety bond, with a reduced amount for certain classes such as motorcycle, ATV, or lessor dealers.
