What the bond actually guarantees

Wyoming licenses collection agencies through the Collection Agency Board, and no one may conduct a collection agency or act as a debt collector in the state without that license. Once your application is approved you have 20 days to file and thereafter maintain either a $10,000 deposit with the state treasurer or a $10,000 surety bond — the license is issued only when the board and the attorney general approve the bond.

It is a three-party arrangement: you (the principal), the surety carrier, and the State of Wyoming plus any claimant as the protected parties. The bond is conditioned on paying over to the claimant the proceeds of every collection, less the agreed collection charges, and it covers all debts placed with you for collection. Claims go to the board first; if the surety does not pay or settle within 30 days of the board's notice, the claimant can sue on the bond directly.

It is not insurance for you — if the surety pays a claim, you repay the surety, and the surety's total exposure never exceeds the $10,000 penalty. Licenses expire December 31 each year and each office is licensed separately, so the bond has to stay continuously on file; we track the term and send renewal notices 60 and 30 days out.

W.S. 33-11-108(a)Wyoming Statute 33-11-108(a) requires a collection agency applicant, within 20 days after notice that the application is approved, to file and thereafter maintain a deposit with the state treasurer or a bond — issued by a surety licensed in Wyoming, in the sum of ten thousand dollars ($10,000.00), running to the state of Wyoming and to any party who may be a claimant. The license issues upon approval of the bond by the board and the attorney general, and W.S. 33-11-108(e) gives a licensee 30 days to file a replacement bond if its surety withdraws.
