What the consumer lender bond covers

Wyoming regulates consumer credit under the Uniform Consumer Credit Code (W.S. 40-14-101 et seq.), administered by the state banking commissioner as administrator through the Division of Banking. A consumer lender license is required for each location where the business of originating consumer loans is regularly conducted, and the Division takes all new license applications through NMLS.

A consumer loan under W.S. 40-14-304(a) is a loan by a person regularly engaged in the lending business where the debtor is an individual rather than an organization, the debt is incurred primarily for personal, family, or household purposes, the debt is payable in installments or carries a loan finance charge, and the principal does not exceed $75,000. Loans primarily secured by a first mortgage on land sit outside that definition and fall under the mortgage licensing statutes instead.

Where the Code requires a bond of a licensed organization, it runs to the state of Wyoming and is forfeited and paid to the state for the benefit of a person damaged by a violation, up to the face amount, with the amount established by rule of the administrator. W.S. 40-14-637(a) provides that where a bond is required of a licensed organization under the Code it is maintained to the state of Wyoming and the amount is established by rule of the administrator based on the volume of activity transacted; subsection (c) forfeits the bond to the state for the benefit of a person damaged by a violation, and subsection (d) keeps it effective until released in writing, otherwise expiring two years after the license is surrendered, revoked, or expires.
