What the AMC bond actually guarantees

South Dakota registers appraisal management companies through the Department of Labor & Regulation’s Appraiser Certification Program, and conditions registration on a $25,000 surety bond under SDCL 36-21D-12. The bond is an appraiser-and-public-protection guarantee.

Specifically, the bond backs the AMC’s obligation to pay the appraisers who perform work for it, and to pay amounts adjudged against it for a negligent or improper appraisal, a negligent or improper appraisal management service, or breach of contract. If the AMC fails and an appraiser or harmed party recovers against the bond, you repay the surety.

The $25,000 must stay continuously on file. If the bond is cancelled or reduced below $25,000, the company must file a replacement or surrender its registration — so we track it and notify you 60 and 30 days out to keep your filing continuous. An irrevocable letter of credit is an accepted alternative under the statute, but a surety bond is usually far cheaper.

SDCL 36-21D-12South Dakota Codified Law 36-21D-12 requires an applicant for issuance or renewal of an appraisal management company registration to file a $25,000 surety bond (or an irrevocable letter of credit) with the Department of Labor & Regulation. How much is the South Dakota AMC bond? +
The premium is $750 — a flat 3% of the fixed $25,000 bond amount, the same for every AMC. The $25,000 is set by statute, so there’s no quote process.
Do I pay the $25,000? +
No. You pay $750. The $25,000 is the surety’s maximum liability if a valid claim is made against the bond — it’s not a deposit, and nobody holds your money.
Can I post a letter of credit instead? +
SDCL 36-21D-12 accepts a $25,000 irrevocable letter of credit as an alternative. Most AMCs choose the surety bond — you pay the 3% premium rather than tying up $25,000 of bank collateral.
Is there a credit check? +
Not on this bond — the application has no credit section at all. Fixed-amount registration bonds like this one don’t need one.
What happens if the bond lapses? +
