What the bond actually guarantees

C.R.S. 12-10-717 requires every licensed Colorado mortgage loan originator to maintain a surety bond — and it expressly allows the bond to be held in the name of the company that employs them. Under the Board of Mortgage Loan Originators' rules (4 CCR 725-3), a company bond covering fewer than 20 individual licensees is set at $100,000; at 20 or more, the amount steps up to $200,000.

It's a three-party arrangement: your company (the principal), the surety carrier, and the State of Colorado (the obligee). The bond stands behind each covered originator's compliance with Colorado's mortgage-origination laws — one instrument in place of a stack of individual $25,000 bonds.

It is not insurance for you — if the surety pays a claim, the company repays the surety. Watch your headcount: the day you cover your 20th licensee, the $200,000 tier applies. The bond must stay continuously on file; we track the term and send renewal notices 60 and 30 days out.

C.R.S. 12-10-717 & 4 CCR 725-3Section 12-10-717 requires each mortgage loan originator to post and maintain a surety bond in an amount prescribed by the Board by rule, and provides that the bond may be held in the name of the employing company. Under 4 CCR 725-3, the company-level bond is $100,000 when it covers fewer than 20 individual licensees and $200,000 when it covers 20 or more.
