Kentucky has a two-tiered process: a hearing officer conducts a hearing and renders a decision; if a party disagrees, a three-member ECAB reviews the decision. The KDE anticipates needing six qualified individuals as ECAB members. Duties may include conducting pre-hearing conferences, preparing correspondence, conducting due process hearings, reviewing evidence and testimony, engaging in legal research and writing decisions, and potentially investigating and deciding IDEA formal complaints. ECAB members receive $125 per hour for service and reimbursement for authorized expenses. They may also serve as due process hearing officers, receiving $125 per hour from the Education Entity for similar work. Travel throughout the Commonwealth and overnight travel may be required.
