Texas licenses title insurance agents and direct operations through the Department of Insurance under Insurance Code Chapter 2651. Each agent and direct operation must make, file, and pay for a surety bond payable to the Department, filed on form FINT122.
The bond is conditioned on paying any pecuniary loss sustained by a participant in an insured real-property transaction through an act of fraud, dishonesty, theft, embezzlement, or wilful misapplication by the agent or direct operation — and on covering Department administrative expense in a receivership.
The amount is set by statute at the greater of $10,000 or 10% of the gross premium written by the agent or direct operation in its latest statistical report to the Department, not to exceed $100,000. Under § 2651.102, TDI also accepts cash, an irrevocable letter of credit, or approved securities in lieu of a bond; the application for the surety bond collects no credit information, and pricing is variable by bond amount, from $100.
