Texas regulates athlete agents under Occupations Code Chapter 2051, administered by the Secretary of State. Under § 2051.151, an agent must — before contacting an athlete or entering into an agent contract — deposit a $50,000 surety bond, payable to the state.
The bond is conditioned on the agent complying with Chapter 2051, paying any administrative penalty assessed under the chapter, and paying any damages awarded to an institution of higher education or to an athlete. It protects athletes and their schools from an agent who breaks the rules.
A separate $100,000 bond is required before an agent enters a financial services contract with an athlete, and a bond must be maintained for at least two years after the later of the date the agent stops providing financial services to the athlete or the date the agent’s registration expires or is revoked.
