What the performance bond actually guarantees

A TABC performance bond is a compliance guarantee: it stands behind your promise to operate your beer license in accordance with the Texas Alcoholic Beverage Code and the rules of the Commission. It is required only of certain on-premise retailers in four large counties — Bexar, Dallas, Harris, and Tarrant — who do not hold a Food and Beverage (FB) certificate.

It's a three-party arrangement: you (the principal), the surety carrier, and the Texas Alcoholic Beverage Commission (the obligee). If TABC forfeits the bond after a code or rule violation, the Commission can recover against it — and you must then file a larger bond before your license is reinstated.

The amount escalates with forfeitures. The first performance bond is $2,000; after a forfeiture, a $4,000 bond is required for reinstatement — this page. A second forfeiture steps the requirement up again. We track your bond and notify you 60 and 30 days before expiration so it stays continuous.
