A PEO co-employs a client's workers and takes on payroll, payroll taxes, benefits, and workers' compensation. The state requires each licensee to demonstrate financial responsibility.
Labor Code §91.014 requires positive working capital in an amount set by the licensee's number of covered employees, and lets a PEO make up any shortfall with a bond, letter of credit, guaranty, or other security acceptable to the department. A surety bond is the common choice because it doesn't tie up the full amount in cash. This $75,000 bond is one of the tiers that applies.
