What the bond actually guarantees

Texas regulates the manufactured-housing trade through the Texas Department of Housing and Community Affairs (TDHCA) Manufactured Housing Division under Occupations Code Chapter 1201. A license applicant or holder must post security, and the bond is a consumer-protection guarantee that you'll comply with Chapter 1201 and the Division's rules.

It's a three-party arrangement: you (the principal), the surety carrier standing behind you, and the State of Texas together with harmed consumers (the protected parties). If a licensee violates the manufactured-housing statute or rules and a buyer is harmed, that buyer can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. Licensees who follow the rules treat the bond as a license formality, not a risk.

Tex. Occupations Code §1201.105–.106Texas Occupations Code §1201.105 requires a manufactured-housing license applicant or holder to file a bond or other security with the TDHCA, and §1201.106 sets the amount: $100,000 for a manufacturer, $50,000 for a retailer, $50,000 for a broker, and $25,000 for an installer. The TDHCA does not require a separate bond for each license type when the capacities are applied for as a single license, so a $50,000 bond covers a retailer/broker/installer combination — confirm the figure on your TDHCA application.

Who requires this bond?The TDHCA Manufactured Housing Division requires it as a condition of a retailer, broker, or installer license under Occupations Code Chapter 1201. No active security, no license.
Is the amount really $50,000 for me?For a retailer or broker, yes — §1201.106 sets retailer and broker security at $50,000 (installer alone is $25,000, manufacturer is $100,000).
