What the bond actually guarantees

Texas regulates manufactured-housing retailers and brokers through the TDHCA Manufactured Housing Division under Occupations Code Chapter 1201. A retailer sells homes to consumers; a broker arranges those sales. Either way, the license is conditioned on security, and the bond is a consumer-protection guarantee that you'll comply with Chapter 1201 and the Division's rules.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Texas with harmed consumers (the protected parties). If a retailer or broker violates the manufactured-housing statute or rules and a buyer is harmed, that buyer can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. Retailers and brokers who follow the rules treat the bond as a license formality, not a risk.

Tex. Occupations Code §1201.105–.106Texas Occupations Code §1201.105 requires a manufactured-housing license applicant or holder to file security with the TDHCA, and §1201.106 sets the amount at $50,000 for a retailer and $50,000 for a broker (an installer alone is $25,000; a manufacturer is $100,000).
