What the bond actually guarantees

A discount health care program sells members access to discounts on health-care services for a fee — it is not insurance. Texas regulates these operators through the Texas Department of Insurance (TDI), which requires registration before a program can be offered in the state.

As a condition of registration, the operator must maintain a $50,000 surety bond payable to the department for the use and benefit of members, under Insurance Code §562.103(f) (with registration governed by Chapter 7001). If the operator fails its obligations to members, they can recover against the bond.

It's a three-party arrangement: you (the principal), the surety, and the TDI together with your members (the protected parties). If the surety pays a claim, you repay the surety — it is not insurance for you. An operator that already holds a TDI certificate of authority as an insurer is exempt from the bond.
