About this bond

What it is and who needs it.

What the fee interest bond actually guarantees

TABC conditions brewer and manufacturer applications — including the non-resident manufacturer's license (BS) — on a $30,000 fee interest bond where the applicant does not own a fee interest (ownership) in a brewery facility, the arrangement used for contract brewing and alternating proprietorships. The bond stands behind the permittee's conformance with the Alcoholic Beverage Code and Commission rules.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Texas through the Commission (the obligee). The bond's condition is that you conform with the Alcoholic Beverage Code and the Commission's rules; if the permit or license is revoked, the amount of the bond is paid to the state.

It is not insurance for you — if the surety pays a claim, you repay the surety. The $30,000 amount is the same across the brewer's permit (B), manufacturer's license (BA), and non-resident manufacturer's license (BS).

TABC fee interest bond — form L-2-18.5 / 16 TAC ch. 33, subch. CTABC form L-2-18.5 ("Fee Interest Bond — Contract Brewing and/or Alternating Proprietorship") is a $30,000 bond that, per the form's own instructions, must accompany all original and renewal applications for a brewer's permit (B), non-resident brewer's permit (U), manufacturer's license (BA) or non-resident manufacturer's license (BS) where the applicant does not own a fee interest (ownership) in a brewery facility. It is conditioned on conformance with the Alcoholic Beverage Code and the rules of the Texas Alcoholic Beverage Commission, whose licensing and bond rules sit at 16 Tex. Admin. Code ch. 33 (subch. C, Bonds), and the amount is paid to the state if the permit or license is revoked. Excise-tax liability is secured separately, on TABC's own tax-security forms. Confirm the form and obligee for your specific permit on your TABC notice.

Renewing that license or permit and your current bond is expiring or being non-renewed
A contract brewer or alternating proprietor brewing at a Texas facility in which you hold no fee interest
Expanding into Texas from out of state and getting licensed here

One application. The whole thing.

These are the actual underwriting fields, including a one-time consent to a soft credit pull. Submit once and your $30,000 bond is typically issued within 1–2 business days.

FAQ

Common questions.

Do I pay the $30,000?No. You pay $325 flat, set by our carrier's rate book for this bond. The $30,000 is the surety's maximum liability to the state; it's not a deposit, and nobody holds your money.
Who requires this bond? The Texas Alcoholic Beverage Commission, as a condition of a brewing or manufacturing permit. The $30,000 amount is set by TABC and shown on your application.
What does the bond guarantee? That you conform with the Alcoholic Beverage Code and the Commission's rules. If your permit or license is revoked, the amount of the bond is paid to the state — and if the surety pays, you repay the surety. Excise-tax liability is secured separately, on TABC's own tax-security forms.
Is there a credit check?Yes — one soft credit pull, which never affects your score. It informs approval, not price. The premium is $325 flat either way: credit can affect whether we approve the bond, never what it costs.
When does it renew?Terms run 1, 2, or 3 years — your choice at purchase. You'll get renewal notices 60 and 30 days before expiration, with autopay available, and the bond must stay active for your TABC permit to stay valid.
