About this bond

What it is and who needs it.

What the bond actually guarantees

Tennessee's Health Club Act treats a prepaid gym membership as something worth protecting: any health club doing business in the state — including a franchise location like Anytime Fitness — must post a $25,000 surety bond for each location before it can lawfully sell memberships. The bond is approved by the Secretary of State and filed with the state's consumer-protection apparatus alongside the club's registration.

It's a three-party arrangement: you (the principal, the franchise operator), the surety carrier, and the State of Tennessee (the obligee), with your members as the protected parties. If the club closes or breaches a membership agreement in a way the Act covers, an affected member can make a claim against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond must stay in force while the location operates, and Tennessee requires it to remain on file for two years after a location stops doing business in the state, so we track your renewal date and notify you before it lapses.

Tennessee Health Club ActTennessee's Health Club Act requires each health club location — a status that applies to a franchised Anytime Fitness location selling memberships in the state — to post a $25,000 surety bond approved by the Secretary of State, in lieu of an audited financial statement showing sufficient net worth. Confirm your location's status with the Secretary of State before filing if you're unsure whether an exemption applies.

FAQ

Common questions.

How much is the Tennessee Anytime Fitness health club bond? The premium is $250 flat — set by our carrier's rate book for this bond, the same for every location. The $25,000 bond amount is set by Tennessee's Health Club Act, so there is no quote process.
Do I pay the $25,000?No. You pay $250. The $25,000 is the surety's maximum liability if a valid member claim is made against the bond — not a deposit, and nobody holds your money.
How fast will I have the bond?Health club bonds like this are among the thousands of bond types that issue right after purchase — many operators finish the application and have the bond in the same sitting. At most, 1–2 business days.
Is there a credit check? The application includes a credit consent, but it authorizes a soft credit pull only — a soft inquiry that never affects your score. No hard inquiry ever runs on this bond.
Do I need a separate bond for each location?Yes. Tennessee's Health Club Act requires a $25,000 bond for each location doing business in the state, so a multi-location Anytime Fitness operator files one bond per address.
