Missouri's Health Spa Act (RSMo 407.325–407.340) treats any business selling nonprepayment health spa contracts — memberships paid for in installments over time — as a regulated health spa, whatever brand it operates under. Before entering into such a contract, the business must file a bond or letter of credit with the Office of the Attorney General — RSMo 407.339 scales the required amount to the location's volume of unexpired contracts, up to $25,000 for the largest locations.
It's a three-party arrangement: you (the principal), the surety carrier, and the State of Missouri, for the benefit of any member (the protected party) if a health spa fails to meet the cancellation, refund, or closure obligations the Health Spa Act imposes, such as those in RSMo 407.330 and 407.332.
It is not insurance for you — if the surety pays a claim, you repay the surety. RSMo 407.340 bars cancelling the bond without the Attorney General's consent, and the bond's aggregate liability is capped at its face amount across every member claim.
