What the bond actually guarantees

The Marion County Engineer issues excavating licenses and special permits for work in the county right-of-way, and conditions them on a bond running to the Board of County Commissioners in a minimum amount of $2,000. The County Engineer's Office must be notified at least 24 hours before work begins.

The bond is a restoration-and-compliance guarantee. It stands behind your obligation to do the excavation to county standards and to restore the right-of-way — the roadway, the surface, the drainage — to the condition Marion County requires. If you don't, the county can recover its restoration costs against the bond.

It's a three-party arrangement: you (the principal), the surety carrier, and the Marion County Board of Commissioners (the obligee). It is not insurance for you — if the surety pays the county, you repay the surety. Permits are valid for 60 days from issuance.
