What the bond actually guarantees

New Hampshire licenses nondepository mortgage bankers, brokers, and servicers under RSA 397-A, administered by the banking department. RSA 397-A:5, III(c) requires a mortgage banker applicant to post a continuous surety bond in the minimum amount of $100,000 running to the commissioner, and the commissioner can set coverage that reflects the loan volume originated by the licensee's mortgage loan originators.

It's a three-party arrangement: you (the principal), the surety carrier, and the bank commissioner (the obligee). The bond stands behind your compliance with the chapter — the licensing, disclosure, fee, and conduct rules that protect New Hampshire borrowers whose loans you originate and fund. The surety must give the commissioner 30 days' written notice before cancellation or termination.

It is not insurance for you — if the surety pays a claim, you repay the surety, and you must immediately file a replacement bond after a successful action. Recovery can be pursued up to six years after the act complained of, so the bond stays continuous; we track the term and send renewal notices 60 and 30 days out.

RSA 397-A:5, III(c)Section 397-A:5 of the New Hampshire Revised Statutes sets the license application requirements under the Licensing of Nondepository Mortgage Bankers, Brokers, and Servicers chapter. Subparagraph III(c) requires a mortgage banker applicant to post a continuous surety bond in the minimum amount of $100,000 running to the commissioner (mortgage brokers post a $50,000 minimum, servicers $100,000), with coverage reflecting the dollar amount of loans originated by each mortgage loan originator as determined by the commissioner. The surety must give the commissioner 30 days' advance written notice of cancellation or termination, and no recovery may be made unless the state claims or suit is brought within 6 years of the act on which it is based.
