What the bond actually guarantees

Montana licenses companies that sell motor club service — towing, emergency road service, insurance, legal service, discount service, financial service, and similar membership benefits sold to motor vehicle owners — through the Commissioner of Insurance, under MCA Title 61, Chapter 12, Part 3. MCA 61-12-302 bars a company from executing, issuing, or delivering a service contract, or collecting any advance payment toward one, without first obtaining that license.

MCA 61-12-304 conditions the license on a $25,000 cash deposit or surety bond, approved by the Commissioner and payable to the State of Montana, conditioned on the company's faithful performance of its service contracts and payment of any fines or penalties levied for noncompliance with the part. The statute is explicit that this deposit or bond "is not a penalty but is for the protection of the public only" — it exists to make good on the promises the company made to its members.

It is not insurance for you — if the surety pays a claim, you repay the surety. MCA 61-12-305 keeps a license (and the bond behind it) in force as long as the company pays its annual license fee by January 1 and remains entitled to hold the license; we track your term and notify you before it needs to be renewed.

MCA 61-12-304Montana Code Annotated 61-12-304 (Deposits required) provides that the commissioner may not grant a license to a motor club service company until it has deposited $25,000 in cash, or in lieu of cash a $25,000 surety bond in a form the commissioner approves, payable to the State of Montana and conditioned on the company's faithful performance of its service contracts and payment of any fines or penalties for noncompliance. MCA 61-12-301 defines "the commissioner" as the Commissioner of Insurance of the State of Montana. A company may be exempted from the deposit or bond only if it proves more than five years of continuous, active Montana operation with over 5,000 members or contract holders, and demonstrates proper management, financial responsibility, and that it is rendering the services it promised.
