What the bond actually guarantees

Minnesota licenses private career schools through the Office of Higher Education, and a person who solicits Minnesota students to enroll must first obtain a solicitor’s permit under Minn. Stat. 136A.825. The permit is conditioned on a $2,000 surety bond (or a $2,000 deposit with the commissioner of management and budget in lieu of bond).

The bond runs to the State of Minnesota and to any student who has a cause of action against the solicitor for breach of a contract or agreement made while soliciting. If a solicitor breaks an enrollment promise and a student is harmed, the student can recover against the bond.

The statute caps the surety’s aggregate liability at the $2,000 principal sum — it is a small, fixed permit bond. The permit expires one year after issuance and is renewed annually, so the bond must stay continuous; we track it and notify you ahead of expiration.
