What the proprietary school bond covers

Kentucky's Commission on Proprietary Education licenses private, for-profit and non-profit schools that offer programs below the bachelor's degree level — trade schools, vocational programs, and the like. (Schools at the bachelor's level and above are licensed instead by the Council on Postsecondary Education.) Each school license is conditioned on a surety bond.

The bond is a student-protection guarantee: it backs the tuition and fees students prepay, providing a financial backstop if the school closes or fails to deliver the training it was paid for. By regulation, the school bond is at least $20,000 per location, and schools also maintain separate agent bonds (generally $5,000 per agent).

It is not insurance for you — if the surety pays a claim, you repay the surety. A letter of credit can be accepted in lieu of the bond. Enter the amount the Commission set on your license, and we issue it at a flat 3% with no credit check.

KRS 165A.360 · 791 KAR 1:150 (Proprietary Education)Kentucky proprietary schools (below the bachelor's degree level) are licensed by the Commission on Proprietary Education under KRS 165A.360, and 791 KAR 1:150 sets bonding for schools and agents — a school surety bond of at least $20,000 per location and an agent bond of at least $5,000 per agent. A letter of credit may be accepted in lieu of the school bond. Confirm the amount on your license.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the Kentucky proprietary school bond? +
The premium is a flat 3% of the bond amount, with a $275 minimum. The bond is at least $20,000 per school location, so the $20,000 minimum bond is $600. Enter your figure and the quote updates.
How is this different from the postsecondary school bond? +
The Commission on Proprietary Education licenses schools below the bachelor's degree level (this bond). The Council on Postsecondary Education licenses schools at the bachelor's level and above (a separate bond). Use the one that matches your school's programs.
Do I need a separate bond for each location and agent? +
Generally yes — the school bond is per location (at least $20,000 each), and schools separately maintain agent bonds (generally $5,000 per agent, or a blanket agent bond). Send us what the Commission required and we'll issue each.
Is there a credit check? +
No — the school bond is issued with no credit pull. Larger bond amounts may get a quick soft-pull review, which never affects your credit score.
Can I use a letter of credit instead? +
The Commission can accept an irrevocable letter of credit in lieu of the school surety bond. Most schools use the surety bond because it ties up no cash or borrowing capacity.
