What the bond actually guarantees

Iowa licenses closing agents — a person who is not a party to the real estate transaction but who provides real estate closing services — through the Division of Banking, part of the Iowa Department of Insurance and Financial Services. Licensure is conditioned on a $25,000 surety bond filed through the Nationwide Multistate Licensing System (NMLS).

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Iowa acting through the Division of Banking (the obligee), with the parties to a closing you handle as the protected side. If a closing agent commits fraud, mishandles funds, or otherwise fails to meet the licensing law's requirements, a harmed party can bring a claim against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. Iowa closing agent licenses run on a calendar-year cycle and expire December 31, with renewal due by December 1 through NMLS, so the bond has to stay in force for the life of the license. We track your term and notify you ahead of expiration to keep the filing continuous.

Iowa Code 535B.9Iowa Code chapter 535B (Mortgage Bankers, Mortgage Brokers, and Closing Agents) requires an applicant seeking to transact business as a closing agent to file a bond in the amount of $25,000 with the administrator — the superintendent of the Division of Banking — unless the administrator sets a higher amount by rule. A licensee may not act as a closing agent unless the bond is in place at the time of a real estate closing.
