About this bond

What it is and who needs it.

What the bond actually guarantees

Iowa Code chapter 536A governs industrial loan companies — lenders operating under an industrial loan license from the superintendent of banking. Under section 536A.7A, a license applicant files a bond furnished by a surety authorized in Iowa; until the superintendent sets a loan-volume-based amount by administrative rule, the bond is $25,000.

It's a three-party arrangement: you (the principal), the surety carrier, and the state (the obligee). The bond is for the use of the state and any persons with causes of action against the company — conditioned on faithfully conforming to chapter 536A and its rules, with the surety answerable for moneys that become due to the state or to those persons under the chapter.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond is continuous until canceled by the surety on at least 30 days' written notice to you and the superintendent, so it stays on file for the life of the license; we track the term and send renewal notices 60 and 30 days out.

Iowa Code § 536A.7ASection 536A.7A of the Iowa Code requires an industrial loan company license applicant to file a surety bond with the superintendent of banking — $25,000 until the superintendent sets an amount reflecting loan volume by rule. The bond is continuous until canceled on at least 30 days' notice, runs for the use of the state and persons with causes of action against the applicant, and is conditioned on faithful compliance with chapter 536A. Alternative collateral acceptable to the superintendent may be pledged in lieu of the bond.
