What the bond actually guarantees

Hawaii registers collection agencies through the Department of Commerce and Consumer Affairs, and HRS 443B-5 requires each agency to file and maintain a bond with the director — $25,000 for the first office in the State and $15,000 for each additional office, written by a surety authorized to do business in Hawaii and running to the State.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Hawaii (the obligee). The bond is conditioned on the agency faithfully, promptly, and truly accounting to its clients — paying over, within thirty days after each calendar month, the net proceeds due on all collections made during that month.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond has to stay continuously on file for the registration to stay in good standing; we track the term and send renewal notices 60 and 30 days out.
