About this bond

What it is and who needs it.

What the bond actually guarantees

An athlete agent recruits or solicits a student athlete to enter an agency contract. Georgia's Athlete Agents law (O.C.G.A. § 43-4A) conditions registration on a surety bond deposited with the Secretary of State — a guarantee that runs to athletic departments harmed by an agent's conduct.

It's a three-party arrangement: you (the principal), the surety carrier, and the State of Georgia (the obligee). The bond is conditioned to pay damages to any athletic department aggrieved by an act of the agent that violates O.C.G.A. § 43-4A-13 or would be grounds for revocation.

The bond must be at least $10,000 and stay in force for your registration. If you let it lapse, your registration is suspended until a new bond is obtained — and you may not act as an athlete agent during suspension. We track it and notify you 60 and 30 days out, keeping your filing continuous.

O.C.G.A. § 43-4A-12 (Secretary of State)O.C.G.A. § 43-4A-12 requires an athlete agent to deposit with the Georgia Secretary of State a surety bond in the penal sum of not less than $10,000 before registration or renewal, executed in favor of the state and conditioned to pay damages to any athletic department aggrieved by an act that violates O.C.G.A. § 43-4A-13 or would be grounds for revocation. Failure to maintain the bond suspends the registration.

FAQs

Common questions.

If yours isn't here, the bond team can usually answer within the hour.

How much is the Georgia athlete agent bond? +
The premium is $300 — a flat 3% of the $10,000 bond amount, the same for every agent. The $10,000 is the statutory minimum, so there is no quote process at that amount.
Do I pay the $10,000? +
No. You pay $300. The $10,000 is the surety's maximum liability if a valid claim is made — not a deposit, and nobody holds your money.
Who requires this bond? +
The Georgia Secretary of State requires it under O.C.G.A. § 43-4A-12 as a condition of athlete agent registration. No active bond, no registration — and a lapse suspends an existing one.
Is there a credit check? +
Not on this bond — the application has no credit section at all. Small fixed-amount license bonds like this one don't need one.
What does the bond protect against? +
It is conditioned to pay damages to an athletic department aggrieved by an agent who violates O.C.G.A. § 43-4A-13 or commits acts that would be grounds for revocation. If the surety pays a claim, you repay the surety.
