What the bond actually guarantees

Florida allows approved third-party administrators (TPAs) — driving schools, tax collectors, and other entities — to give the Class E driver license knowledge exam on the DHSMV's behalf. Because the TPA collects fees and stands in for the state, the DHSMV requires a $200,000 performance bond as a condition of the testing agreement.

The bond is a performance and fidelity guarantee: it backs the administrator's compliance with Florida Statutes Chapter 322, Florida Administrative Code Rule 15A-1, and the Class E Knowledge Exam Contract. If a TPA commits fraud, misuses exam fees, or breaches the contract, the DHSMV and harmed test-takers can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. Note that the knowledge exam and the driving-skills exam are bonded separately; an administrator approved for both holds $200,000 for each. This page covers the knowledge-exam bond.
