What the distributor bond actually guarantees

Florida licenses alcoholic beverage distributors through the DBPR Division of Alcoholic Beverages and Tobacco. A KLD license lets a distributor sell beer, wine, and spirits to vendors and other distributors, and §561.37, F.S. conditions the license on a surety bond guaranteeing payment of the beverage excise taxes the distributor owes.

Because spirits carry the highest excise tax, the bond for a beer-wine-liquor distributor is set at $100,000 — four times the $25,000 beer-and-wine figure. It is a three-party arrangement: you (the principal), the surety, and the State of Florida as obligee, with the bond securing every dollar of beverage tax due.

It is not insurance for you — if the surety pays the state for unremitted beverage taxes, you repay the surety. Distributors who file their monthly reports and remit on time treat the bond as a license formality. We track it and notify you 60 and 30 days before it expires.
