What the health studio bond actually guarantees

Florida’s Health Studio Act (§§501.012–501.019, F.S.) requires gyms, fitness clubs, and similar studios to register with the Department of Agriculture and Consumer Services (FDACS) and post a $25,000 surety bond. The bond protects members who pay dues in advance, in case the studio closes before delivering the services they paid for.

It is a three-party arrangement: you (the principal), the surety carrier, and the State of Florida and harmed members as the protected parties. If a studio collects prepaid dues and then fails to provide the contracted services, an injured member can recover against the bond.

A separate bond is generally required for each business location, and the bond must stay active for as long as you operate. The Act exempts a studio that collects payment month by month, with any service fee reasonable and fair (§501.016(5)), and one that has operated in compliance under the same ownership for the most recent five years with no adjudication against it and no unresolved complaints (§501.016(8)) — confirm your situation with FDACS. We track it and notify you 60 and 30 days out.
