When a Florida nursing facility is operated by a leasehold licensee — an operator running the home under a lease rather than owning it — §400.179, F.S. requires extra financial protection for the Medicaid program. The concern is that a leasehold operator may have fewer recoverable assets if a Medicaid overpayment is later identified by audit.

The leasehold licensee must acquire and maintain a bond, with a term of 30 months, renewable annually, in an amount not less than the total of three months’ Medicaid payments to the facility, computed on the basis of the preceding 12-month average. The bond is filed with the Agency for Health Care Administration (AHCA).

As an alternative, the statute lets a licensee pay a nonrefundable fee — generally 1% of three months’ Medicaid payments — into the Medicaid nursing home overpayment account instead of posting a bond.
