What the bond actually guarantees

Sarasota County permits work in its public right of way and conditions that permit on a right-of-way use bond of 110% of the estimated construction cost, but not less than $15,000. The County can ask for more, based on the class of road, the utilities in it and the scope of the work. The bond is a restoration-and-public-protection guarantee: it stands behind your obligation to restore the right of way and comply with the county permit conditions when you cut, bore, or build within county roads and easements.

It's a three-party arrangement: you (the principal), the surety carrier standing behind you, and Sarasota County (the obligee, the party the bond is payable to), with the public as the protected party. If the right of way is damaged and not restored, or permit conditions are violated, the county can recover against the bond.

It is not insurance for you — if the surety pays a claim, you repay the surety. We track the bond and notify you 60 and 30 days before expiration so your permit coverage never lapses over a missed renewal.

Ord. 2024-051); § 118-111Sarasota County Code § 124-48 requires an executed right-of-way use bond, acceptable to the County and the Office of the County Attorney, with every Right-of-Way Use Permit application: 110% of the estimated construction costs, but not less than $15,000. The County Administrator may require more surety based on the road, the utilities in it and the scope of the work. For communications facilities, § 118-111 sets the surety at $15,000 or the County Procurement Insurance Matrix amount, whichever is greater; a professional engineer's estimate that restoration will cost less can support a lower amount, and the County can waive the surety in writing for a small project.
