What the public official bond actually covers

Many Florida public offices — clerks, tax collectors, commissioners, district officers, and others — must post a bond before taking office. The bond is a faithful-performance and fidelity guarantee: it stands behind the officer’s honest handling of public funds and faithful execution of the duties of the office.

Florida’s general rule, §113.07, F.S., requires that when such bonds are required, they be written by a surety company authorized to do business in Florida. The statute also directs that the base premium be paid from the public treasury (state general revenue, county, or district), with any excess premium above the base rate paid by the officer. It expressly does not apply to deputy sheriffs, notaries, or special process servers under §48.021.
