What the game promotion bond actually covers

Florida regulates game promotions — sweepstakes, contests, and prize giveaways run with the sale of consumer products or services — under §849.094, F.S., administered by the Department of Agriculture and Consumer Services. When the total announced value of prizes exceeds $5,000, the operator must guarantee the prizes.

There are two accepted ways to do that: establish a trust account with a balance sufficient to pay all prizes, or post a surety bond in an amount equal to the total value of all prizes offered. The statute requires the bond to equal that total at all times. The operating rules and the security must be filed with the department at least 7 days before the promotion begins.

The bond guarantees that winners actually receive the prizes promised. If the operator fails to award them, a claim can be made against the bond — and if the surety pays, the operator repays the surety.
