What the bond actually guarantees

Florida regulates professional guardians under Chapter 744, Part II. A professional guardian must post a blanket fiduciary bond with the clerk of the circuit court in the county of the guardian’s primary place of business, maintained in an amount not less than $50,000 and covering all wards for whom the guardian is appointed at any given time.

The bond runs to the Governor of Florida and is conditioned on the faithful performance of all duties by the guardian. The acts or omissions of each employee who has direct contact with a ward or access to a ward’s assets are covered, and the surety’s liability is limited to the face amount regardless of how many wards the guardian serves.

This blanket bond is separate from any individual guardianship bond a court sets for a specific ward’s assets under §744.351. It is not insurance for you — if the surety pays a claim, you repay the surety.

§744.2102, Fla. Stat.Section 744.2102, Florida Statutes, requires a professional guardian to post a blanket fiduciary bond with the clerk of the circuit court in the county of the guardian’s primary place of business, in an amount not less than $50,000, covering all wards. The bond is payable to the Governor, conditioned on faithful performance, and covers employees with direct ward contact or asset access; the surety’s liability is limited to the face amount. This is separate from a court-set bond on a specific ward’s assets under §744.351.
