What the process server bond guarantees

The Twelfth Judicial Circuit covers DeSoto, Manatee and Sarasota counties — Sarasota, Bradenton, Venice, Arcadia, Palmetto, North Port — and appoints certified process servers under the Certified Process Servers Act, Fla. Stat. §§48.25–48.31. The circuit’s standing administrative order on appointments is in the 2015-24.2 series.

The circuit’s packet is heavier than most. Alongside the bond, applicants supply three letters of recommendation, at least one from a member of The Florida Bar, and satisfy the circuit’s examination and background requirements. The bond itself must be executed in the amount of $5,000 with a surety company authorized to do business in the State, for the benefit of any person wrongfully injured by malfeasance, misfeasance, neglect of duty or incompetence in connection with the server’s duties.

One rule catches people out: there can be no lapse in the bond at any time during the one-year certification. A cancelled or expired bond mid-year is a compliance problem, not a paperwork nuisance — so either renew early or buy a two- or three-year term up front. We track your expiry and notify you 60 and 30 days out either way. And if you serve in a second circuit, that circuit wants its own $5,000 bond.

The Twelfth Judicial Circuit governs appointment of certified process servers for DeSoto, Manatee and Sarasota counties by administrative order in the 2015-24.2 series, which also calls for three letters of recommendation including at least one from a member of The Florida Bar, and provides that there may be no lapse in the bond at any time during the one-year certification.
