What the process server bond guarantees

Individuals designated as certified process servers in the Tenth Judicial Circuit, in and for Hardee, Highlands and Polk counties, hold all the powers and duties conferred by Fla. Stat. §§48.25–48.31 — they may serve process anywhere in the circuit without a separate court appointment in each case.

The circuit’s standing order on the program, Administrative Order No. 1-29.6, requires each designee to execute and file with the Office of the Court Administrator a bond in the amount of $5,000 with a surety company authorized to do business in this state. The Administrative Office of the Courts and the Clerks of the Court maintain the current approved list, and that list is amended to add — or delete — names as bonds and good standing change.

The bond protects the public, not you. It answers to any person wrongfully injured by a server’s malfeasance, misfeasance, neglect of duty or incompetence; if the surety pays, you repay the surety. Because designation is annual, the bond is annual. We track your expiry and send notices 60 and 30 days out so your name never drops off the list over a lapsed filing.
