What the process server bond guarantees

The Eleventh Judicial Circuit is Miami-Dade County, and it certifies and regulates Certified Civil Process Servers by standing administrative order under the Certified Process Servers Act, Fla. Stat. §§48.25–48.31. The current order in the series is AO 24-08 A1. Certified servers pass background screening, complete mandatory training, and maintain the $5,000 bond the Administrative Office of the Courts requires.

Miami-Dade adds a procedural wrinkle worth knowing before you buy: the bond is approved by the Clerk of the Courts prior to presentation to the AOC, and it is renewable on an annual basis. Practically, that means the executed bond has to exist — properly issued by a surety authorized in Florida, with a power of attorney attached — before the rest of your packet can move. The program office sits at the Dade County Courthouse, 73 West Flagler Street, Room 911.

The bond runs to the public. It answers to any person wrongfully injured by a server’s malfeasance, misfeasance, neglect of duty or incompetence in connection with the job, and if the surety pays a claim you repay the surety.
