About this bond

What it is and who needs it.

What the process server bond guarantees

The Eighteenth Judicial Circuit serves Brevard and Seminole counties — Titusville, Melbourne, Viera, Palm Bay, Sanford, Altamonte Springs, Oviedo — and certifies private process servers under the Certified Process Servers Act, Fla. Stat. §§48.25–48.31. Applicants are pointed to the circuit’s standing order on process servers, AO 20-34-B-Amd, alongside the statutes themselves.

Every applicant, new or renewal, submits an application to the Clerk of Court with a non-refundable application fee of $100 — a court fee, entirely separate from your bond premium — and a $5,000 surety bond payable to the Eighteenth Judicial Circuit. One quirk worth knowing: the two counties keep the records differently. In Brevard, the Clerk of Court maintains all process server information; in Seminole, the Sheriff’s Office does. Ask the right office before you chase a status.

The bond runs to the public, not to you. It answers to any person wrongfully injured by a server’s malfeasance, misfeasance, neglect of duty or incompetence in connection with the job, and if the surety pays a claim you repay the surety. Certification is annual, so the bond is annual — we track your expiry and send notices 60 and 30 days out. A second circuit means a second $5,000 bond.

Fla. Stat. §§48.25–48.31 · Eighteenth Circuit AO 20-34-B-AmdFla. Stat. §48.29 requires a certified process server to execute a bond in the amount of $5,000 with a surety company authorized to do business in this state, renewable annually, for the benefit of any person wrongfully injured by any malfeasance, misfeasance, neglect of duty or incompetence of the applicant in connection with his or her duties as a process server. The Eighteenth Judicial Circuit directs applicants to Administrative Order 20-34-B-Amd and §§48.25–48.31, and requires each applicant — new or renewal — to submit an application to the Clerk of Court with a non-refundable fee and a $5,000 surety bond payable to the Eighteenth Judicial Circuit. Process server records are maintained by the Clerk of Court in Brevard County and by the Sheriff’s Office in Seminole County; confirm the current order and fee with the appropriate office.

FAQ

Common questions.

How much is the 18th Circuit process server bond? The premium is $100 for a one-year term, the same for every applicant. The $5,000 penal sum is set by Fla. Stat. §48.29 and the circuit’s administrative order, so there is no quote step.
Do I pay the $5,000?No. You pay the premium. The $5,000 is the surety’s maximum liability on a valid claim by a person wrongfully injured by your work — not a deposit, and nobody holds your money.
How fast will I have the bond?Court certification bonds like this are among the thousands of bond types that issue right after purchase — most applicants have the e-signed bond in the same sitting.
Is there a credit check? The application collects no credit information — no credit section anywhere on this form. Most applications approve instantly, and if a check ever runs it is a soft pull that will not affect your score.
Do Brevard and Seminole handle this the same way?The bond requirement is identical — $5,000, payable to the Eighteenth Judicial Circuit, submitted with an application and a non-refundable fee to the Clerk of Court. Record-keeping differs: in Brevard the Clerk of Court maintains all process server information, while in Seminole the Sheriff’s Office does. Direct status questions to whichever office holds your county’s records.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
