What the bond actually guarantees

A City of Jacksonville right-of-way bond is a municipal performance guarantee. For any right-of-way work other than a residential driveway, the City requires a permit applicant to file, or already have on file, a $50,000 bond (or an irrevocable letter of credit) that stays in force for one year. One bond on file covers your permits.

It's a three-party arrangement: you (the principal), the surety carrier, and the City of Jacksonville (the obligee, the party the bond is payable to). If you fail to restore or repair damage to a City road, right-of-way or easement, or to follow Ordinance Code §744.110 and your permit, the bond covers loss to the City or an adjoining property owner, including the cost of barricades and warning signals. If the City draws on it, you must bring it back to the full $50,000 as soon as the City gives notice.

It is not insurance for you — if the surety pays the City, you repay the surety. The bond runs one year at a time, so renew it to keep a current bond on file whenever you apply for a right-of-way permit.

Jacksonville Ordinance Code §744.110(c)(2) (amended through Ord. 2024-950-E); "Surety Bond For Work in the Right of Way" form (Apr 2026)The City of Jacksonville (Duval County consolidated government) requires an applicant for a right-of-way permit to file, or have on file, an annual surety bond or irrevocable letter of credit of $50,000, effective for one year and payable to the City. It is kept on file with the Development Services Division, which needs the original sealed bond, delivered in person or by mail to 214 N. Hogan St., Second Floor. Residential driveway work is separate: §744.110(c)(1) names a $10,000 letter of credit, and the City also posts a $10,000 driveway bond form.
