What the bond actually guarantees

A City of Hollywood right-of-way public-construction bond is a restoration guarantee. Under Code §104.35, anyone who digs into a city street, alley, sidewalk or way must apply for a permit and post a bond with surety, approved by the City Manager or a designee. The bond guarantees you restore the street, alley, sidewalk or way to the condition it was in before the excavation, and its amount is the City's estimate of the repair cost. A public utility with a continuing indemnity agreement on file with the City Manager does not have to post one.

It's a three-party arrangement: you (the principal), the surety carrier, and the City of Hollywood (the obligee, the party the bond protects). If the street, alley, sidewalk or way isn't restored, the City can recover the repair cost against the bond.

It is not insurance for you — if the surety pays the City, you repay the surety. Once the City inspects and approves your repair, you are released from the bond. For a Chapter 55 Construction Bond, half is released when the restoration is approved and the rest after 12 months.

Hollywood Code §104.35; Ch. 55 (§§55.12, 55.35)Section 104.35 requires anyone who digs into a city street, alley, sidewalk or way to apply for a permit and post a bond with surety, approved by the City Manager or a designee. The bond is conditioned on restoring it to its condition before the excavation, in an amount equal to the cost of the repair, and is released once the City approves the repair. A public utility with a continuing indemnity agreement on file is exempt. Utility and communications companies registered under Chapter 55, or contractors applying for them, post a Construction Bond (§§55.12, 55.35), usually 110% of the estimated cost; cash, certified funds or a letter of credit also qualify. The City's online right-of-way checklists list no bond, so confirm with the Engineering Division which rule applies to you.
