Washington licenses escrow agents under the Escrow Agent Registration Act, chapter 18.44 RCW, administered by the Director of Financial Institutions. An escrow agent is the neutral third party that holds money and documents in a real estate or personal property transaction until the closing conditions are met — and RCW 18.44.201 conditions the license on a surety bond of $10,000, alongside a fidelity bond and an errors and omissions policy.
The bond runs to the state of Washington as obligee and to the benefit of the state and any person who suffers loss. It is conditioned on the licensee faithfully conforming to chapter 18.44 RCW and the rules adopted under it, and reimbursing anyone who suffers loss because of a violation — the escrow-account, trust-fund, and closing rules that protect buyers, sellers, and lenders.
