How it works

Built around the land-disturbance permit.

Development Services will not issue the permit until the security is in hand, and grading cannot start without the permit. Here is the whole process:

About this bond

What it is and who needs it.

What the Roanoke County erosion bond guarantees

Chapter 8.1 of the Roanoke County Code is the County’s Erosion and Stormwater Management Program, re-enacted by Ord. No. 092325-3 on September 23, 2025 under the Virginia Erosion and Stormwater Management Act. It regulates land-disturbing activity of 2,500 square feet or more (§ 8.1-5), and no one may disturb land until the County grants land-disturbance approval (§ 8.1-7(a)). Chapter 8.1 also applies inside the Town of Vinton.

Section 8.1-27 then requires the applicant, before any permit issues, to submit a reasonable performance bond with surety, cash escrow, letter of credit, a combination, or another arrangement acceptable to the County Attorney. The bond guarantees the County can take the measures your permit conditions require — installing or maintaining silt fence, construction entrances, sediment traps and basins — at your expense if you fail to do so after proper notice. If the County’s cost runs past the bond, it can collect the difference from you.

The code sets no amount. In practice the County sizes each bond from the erosion-control cost estimate on the approved plan, priced from its posted Erosion and Sediment Control Unit Cost Table, and the Director of Development Services signs the bond form to approve the amount. The County Attorney’s Office approves the form, and the surety must be authorized to write surety in Virginia. Smaller sites that use an agreement in lieu of a plan under § 8.1-13(c) sign a form that carries no bond term.

It is a three-party arrangement: you (the principal), the surety, and the Board of Supervisors of Roanoke County (the obligee). If the surety pays a claim, you repay the surety. This bond is separate from the site-development bond the County takes for public improvements and from the stormwater-facility maintenance guaranty; each is posted on its own.

Roanoke County Code Ch. 8.1, § 8.1-27Roanoke County Code § 8.1-27 (Ord. No. 092325-3, 9-23-25) requires that, prior to issuance of any permit, the applicant submit a reasonable performance bond with surety, cash escrow, letter of credit, any combination thereof, or other legal arrangement acceptable to the County of Roanoke Attorney, to ensure that measures could be taken by the County at the applicant’s expense should the applicant fail, after proper notice, within the time specified to initiate or maintain the actions the permit conditions require as a result of the land-disturbing activity. The County may collect any cost of that action beyond the security held, and within 60 days of completion of the permit conditions the bond, or its unexpended portion, is refunded or terminated. Section 8.1-6(e) likewise lets the County require the bond as part of the land-disturbance approval process. The state enabling authority is Code of Virginia § 62.1-44.15:34(A)(4). The County’s Erosion and Sediment Control Bond Form runs to the Board of Supervisors of Roanoke County, Virginia.

Claims, renewal, filing, and what sets the price.

If a claim is made

A claim comes from the party the bond protects, the obligee named on the form, when the duty the bond guarantees is not met.

The surety investigates and pays a valid claim, up to the bond amount. You then repay the surety: a surety bond is a guarantee of your performance, not insurance for you.

Renewal and term

Term and renewal are set in the underwriter's quote.

Keep the bond in force for as long as the obligation behind it runs.

How to file it

Execute & file with Development Services. Once you bind, we issue the executed bond on the County’s Erosion and Sediment Control Bond Form with the power of attorney attached, ready to file with your signed Erosion and Sediment Control Agreement.

What sets the price

This bond is underwritten: the premium is quoted from the bond amount and your financial picture, so there is no flat price to show.

FAQ

Common questions.

What is a Roanoke County, Virginia erosion and sediment control bond?It is the performance bond Roanoke County Code § 8.1-27 requires before the County issues a permit for land-disturbing activity. It guarantees that the County can install or maintain the erosion and sediment controls your permit requires, at your expense, if you fail to do it after proper notice. The bond runs to the Board of Supervisors of Roanoke County.
Who sets the bond amount?Roanoke County does, project by project. The code requires a reasonable bond without naming a figure. The County sizes it from the erosion-control cost estimate on your approved plan, priced from its Erosion and Sediment Control Unit Cost Table, and the Director of Development Services approves the amount on the bond form. Confirm the figure with Development Review before you apply.
How much does it cost?It is underwritten, not flat-rated. The premium depends on the penal sum, the size of the land disturbance, your track record with site work, and your finances. A surety specialist reviews the file and returns a quote, usually within one business day. The application includes a credit consent, but it authorizes a soft credit pull only — a soft inquiry that never affects your score. No hard inquiry ever runs on this bond.
Will I need collateral?Usually not on a typical site, but it can come up on a large grading project with a high erosion-control estimate, or where the applicant is new to land development. We tell you what your file needs before you commit. The County also accepts cash escrow or a letter of credit instead of a bond; the bond keeps that cash free for the job.
When is the bond released?Section 8.1-27 says that within 60 days of completing the requirements of the permit conditions, the bond or its unexpended portion is refunded or terminated. The County’s bond form sets a completion date one year from the agreement, and if the work is not done by then the bond stays in force until it is discharged, so keep it active through final stabilization.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
