About this bond

What it is and who needs it.

What the Lynchburg solicitor bond guarantees

Chapter 29 of the Lynchburg City Code (Peddlers and Solicitors) makes it a class 2 misdemeanor to do business as a peddler in the city without a permit (Sec. 29-19). The code defines “peddler” broadly in Sec. 29-1: anyone traveling from place to place, house to house or street to street selling goods, or taking orders for goods to be delivered or services to be performed in the future — and it expressly includes the canvasser, the solicitor, the transient or itinerant merchant or vendor, and the transient or itinerant photographer.

Every permit applicant files a sworn application with the Chief of Police (Sec. 29-20), submits to fingerprinting (Sec. 29-23), goes through a police investigation of business and moral character that the Chief completes within two weeks (Sec. 29-26), and pays a nonrefundable $15.00 processing fee (Sec. 29-28). The bond is an additional requirement that falls only on applicants who are not Lynchburg residents, and on residents who represent a firm whose principal place of business is outside Virginia.

The bond does three things under Sec. 29-24(a). It guarantees you will comply with the City Code, city ordinances and state law on peddling. It guarantees to any Lynchburg citizen that money paid as a down payment will be accounted for and applied as you represented. And it guarantees that property a citizen buys from you will be delivered as you represented. A claim can be brought in the City’s name for the benefit of the person harmed, and before the permit issues you appoint the Chief of Police as your agent to accept service of any suit on the bond (Sec. 29-25).

It is a three-party arrangement: you (the principal), the surety, and the City of Lynchburg (the obligee). If the surety pays a claim, you repay the surety. This is not Virginia’s charitable-fundraising “professional solicitor” bond, which is a separate $20,000 bond filed with the Commissioner of Agriculture and Consumer Services under Code of Virginia § 57-61.

Lynchburg City Code Ch. 29, Art. II, Sec. 29-24Lynchburg City Code Sec. 29-24(a) requires every permit applicant who is not a resident of the city, or who is a resident representing a firm whose principal place of business is outside the state, to file with the Chief of Police a surety bond from a company licensed to do business in Virginia, running to the city in the amount of $1,000, with surety approved by the Chief of Police. It is conditioned on compliance with the City Code, city ordinances and state law on peddling, on accounting for and applying customer down payments as represented, and on delivering purchased property as represented; action on the bond may be brought in the city’s name for the aggrieved person. Sec. 29-24(b) lets a corporation authorized to do business in Virginia, or a business registered under the state fictitious-name statute, furnish one $1,000 bond for all of its agents, employees, canvassers or solicitors. Permits last no longer than 12 months (Sec. 29-32). Chapter 29 does not apply to commercial travelers selling to dealers, public officers selling according to law, Virginia residents selling farm products they raised in Virginia, or charitable, educational and religious organizations whose principal place of activity is in Lynchburg (Sec. 29-2).

You need this bond if you’re

✓

✓
A Lynchburg resident selling for an out-of-state firm — a company whose principal place of business is outside Virginia
✓
A company sending a crew into the city — home services, solar, roofing, pest control or subscriptions — that wants one bond covering every solicitor
✓
A transient or itinerant merchant or photographer renting a room, lot or storefront in Lynchburg for temporary sales
After you buy

Claims, renewal, filing, and what sets the price.

If a claim is made

A claim comes from the party the bond protects, the obligee named on the form, when the duty the bond guarantees is not met.

The surety investigates and pays a valid claim, up to the $1,000 bond amount. You then repay the surety: a surety bond is a guarantee of your performance, not insurance for you.

Renewal and term

The term is set on the carrier’s application; the premium covers the period shown there.

Renew before the expiry date to keep the bond in force: the license, permit or contract it backs expects continuous coverage.

How to file it

File with the Chief of Police. Your executed bond and power of attorney arrive by email, ready to file with the Lynchburg Police Department together with your sworn permit application.

What sets the price

The premium is fixed at $100 at the $1,000 amount for every applicant: the carrier’s rate book prices this bond by the form, not by your credit or your business profile.

FAQ

Common questions.

What is a Lynchburg, Virginia peddler and solicitor bond?It is the $1,000 surety bond Lynchburg City Code Sec. 29-24 requires of certain applicants for a peddler’s permit from the Chief of Police. It guarantees the permit holder follows the city and state rules on peddling, applies customers’ down payments as promised, and delivers what was sold. The code’s definition of peddler covers canvassers, solicitors and itinerant merchants.
How much is the Lynchburg peddler and solicitor bond? The premium is $100 flat for a term — set by our carrier's rate book for this bond, not a percentage formula. The $1,000 bond amount is set by City Code Sec. 29-24, and Sec. 29-24(b) sets the same $1,000 figure for a single company bond covering all of a firm’s agents, canvassers and solicitors.
Do I need the bond if I live in Lynchburg?Usually not. The bond applies only to applicants who are not city residents, and to city residents who represent a firm whose principal place of business is outside Virginia. A Lynchburg resident selling on their own account or for a Virginia-based firm still needs the permit, fingerprints and $15.00 fee, but no bond.
Is there a credit check? No credit check: the application collects no credit information. No. Most applications approve instantly.
How long does the permit and bond last? The permit is valid for the period stated on it and never more than 12 months (Sec. 29-32), so plan to keep the bond in force for the life of the permit and to renew both together. The Chief of Police can revoke a permit for code violations or false information on the application (Sec. 29-33).
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
How do I contact Light RFP about this bond?Email insurance@lightrfp.com. It reaches the bond team at Light RFP Risk Management Services LLC (NY DFS License # PC-1978982). Write to us about quotes, applications, bond forms or certificates. We will respond within 24 hours.
