How it works

Built around the excavation permit.

T&ES issues the permit only after the bonds and insurance certificates are deposited with the Director. Here is the whole process:

TODAY · ONE APPLICATION

Send us the file

Apply online with your company details, the address of the opening, and the bond amount T&ES set for the work. Tell us whether you need a combined single-location bond or a continuing bond for a year of permits.

WITHIN 1 BUSINESS DAY

A surety specialist underwrites it

A specialist reviews the amount, the scope of the excavation and restoration, the one-year maintenance tail, and your record on right-of-way work, then returns a quote. The City fixes the amount — underwriting decides approval and any collateral.

ON APPROVAL

Execute & deposit with T&ES

Once you bind, we issue the executed bond with the power of attorney attached, in the exact name on your permit application, ready to deposit with the T&ES Permit Center through APEX.

About this bond

What it is and who needs it.

What the Alexandria street opening bond guarantees

Alexandria City Code § 5-2-141 makes it unlawful to dig up, break, excavate, tunnel or undermine any street, or to excavate in the right-of-way, without a permit from the Director of Transportation and Environmental Services (T&ES). The code’s definition of “street” in § 5-2-101 reaches public sidewalks, alleys, easements and rights-of-way the City accepts or maintains — which is why a sidewalk cut, a utility tap or a sewer lateral connection all need the same permit, and the same bonds.

Section 5-2-155 then requires two bonds before the permit issues. The performance and payment bond guarantees you complete the opening in compliance with the City’s street-opening regulations and other city and state law, and that you pay for any work beyond the original permit. The maintenance bond guarantees you keep the completed opening in good repair; it starts when you notify the City the work is done and ends on the Director’s final inspection, but never less than one year after that notice.

The Director sets each amount at the cost of the work. The City’s T&ES Permit Guidelines add a $1,000 minimum for each bond per permit, and a contractor expecting more than one permit a year may post continuing bonds of at least $5,000 each. For work at only one location, the guidelines allow a single combined bond that runs on the maintenance schedule. The principal on the bond must match the applicant or contractor on the permit exactly, and a certified or cashier’s check is accepted in its place.

It is a three-party arrangement: you (the principal), the surety, and the City of Alexandria (the obligee). If the surety pays a claim, you repay the surety. Liability insurance is a separate requirement, and so is the smaller per-location bond T&ES takes for permits to cross the curb, gutter and sidewalk.

Alexandria City Code Title 5, Ch. 2, Art. E, § 5-2-155Alexandria City Code § 5-2-155 requires every person seeking a permit under § 5-2-141 to first furnish the Director of Transportation and Environmental Services with (1) a performance and payment bond conditioned on completing the opening in compliance with the regulations governing street openings and other city and state law, and on paying for additional work beyond the original permit, in an amount sufficient to cover the cost of making the opening as determined by the Director, which may be a continuing bond of not less than $5,000 where there is more than one permit per year; and (2) a maintenance bond conditioned on keeping the completed opening in good repair, running from the permittee’s notice of completion until the Director’s final certificate of inspection but never less than one year after that notice, in an amount sufficient to cover maintaining and repairing the opening, likewise continuing at not less than $5,000 for multiple permits a year. Section 5-2-143 issues the permit on deposit of the required bonds and insurance certificates. The City’s T&ES Permit Guidelines set a $1,000 minimum for each bond per permit, allow a combined bond for a single location, and accept a certified or cashier’s check in lieu of a bond.

You need this bond if you’re

✓
A utility, paving or excavation contractor opening an Alexandria street, sidewalk or alley for a service line, repair or new connection
✓
A plumber connecting a sanitary sewer lateral — T&ES applies the same bonding as an excavation permit
✓
A builder or property owner whose project needs a cut in the public right-of-way in front of the site
✓
A contractor pulling several permits a year who wants a continuing bond instead of one bond per job
After you buy

Claims, renewal, filing, and what sets the price.

If a claim is made

A claim comes from the party the bond protects, the obligee named on the form, when the duty the bond guarantees is not met.

The surety investigates and pays a valid claim, up to the bond amount. You then repay the surety: a surety bond is a guarantee of your performance, not insurance for you.

Renewal and term

Term and renewal are set in the underwriter's quote.

Keep the bond in force for as long as the obligation behind it runs.

How to file it

Send us the file. Apply online with your company details, the address of the opening, and the bond amount T&ES set for the work. Tell us whether you need a combined single-location bond or a continuing bond for a year of permits.

What sets the price

This bond is underwritten: the premium is quoted from the bond amount and your financial picture, so there is no flat price to show.

FAQ

Common questions.

What is an Alexandria, Virginia street and sidewalk opening bond?It is the bond Alexandria City Code § 5-2-155 requires before the T&ES Director issues a permit to excavate in a street, sidewalk, alley or other public right-of-way. It guarantees the opening is completed and restored to City standards, that extra work beyond the permit is paid for, and that the patch is kept in repair for at least a year after you report completion.
Who sets the bond amount? The Director of Transportation and Environmental Services, at the cost of making the opening and of maintaining and repairing it. The City’s T&ES guidelines set a $1,000 minimum for each bond per permit, and a continuing bond for a contractor with more than one permit a year must be at least $5,000. Confirm the figure with the T&ES Permit Center before you apply.
Do I need two bonds or one?The code calls for two: a performance and payment bond and a maintenance bond. If your permit covers work at only one location, the City’s guidelines let you post one combined bond, which ends on the maintenance-bond schedule. Contractors with several permits a year often post continuing bonds instead.
Will I need collateral?Usually not on a routine single-location opening, but it can come up on a large continuing bond or a deep excavation with a costly restoration. On credit: the bond issues the moment you pay — no credit review of any kind, not even a soft pull. We tell you what your file needs before you commit.
When does the bond end?The maintenance obligation starts on the date you notify the City the work is complete and ends when the Director issues a final certificate of inspection, but never less than one year after your notice. A combined single-location bond ends on the same schedule, so budget for the bond to stay in force for at least a year after restoration.
Which A-rated carriers underwrite these bonds?Typically Arch Insurance Company (A.M. Best A+) or Nationwide Mutual Insurance Company (A.M. Best A). Which one writes your bond depends on the bond type and your state. The carrier's name and official signature are printed on the bond you receive.
