About this bond

What it is and who needs it.

What the malt beverage bond actually covers

Virginia imposes an excise tax on beer and malt beverages, and the Virginia Alcoholic Beverage Control (ABC) Authority requires every manufacturer, bottler, and wholesaler to bond that tax. The bond is conditioned on payment of the excise tax imposed by § 4.1-236 and runs to the benefit of the Commonwealth.

Under Code of Virginia § 4.1-238, the bond amount is proportioned to your volume of business, but never less than $1,000 or more than $100,000. Licensees file monthly reports of the beer they manufactured, bottled, or sold, and the tax due — the bond stands behind that obligation.

If you fail to remit the beer excise tax, the ABC Authority can recover against the bond. Enter the amount ABC set for your volume; pricing starts from $100, and the application collects no credit information at the standard amount — and if the surety ever pays, you repay the surety.

Code of Virginia § 4.1-238 (Virginia ABC)Under Code of Virginia § 4.1-238, every malt beverage manufacturer, bottler, or wholesaler must file a bond with the Virginia ABC Authority, proportioned to volume of business but never less than $1,000 or more than $100,000, conditioned on payment of the beer excise tax imposed by § 4.1-236. Licensees file monthly tax reports. Confirm your required amount on your ABC application.

FAQ

Common questions.

How much is the Virginia malt beverage bond?Pricing is 1% of your bond amount, with a $100 minimum. The amount itself is set by the ABC Authority, proportioned to your volume of business — never less than $1,000 or more than $100,000. Enter the figure ABC set and your exact price appears in the application.
Why does Virginia require it?It secures the beer excise tax. Under § 4.1-238 the bond is conditioned on payment of the tax imposed by § 4.1-236, so the Commonwealth has a guarantee that manufacturers, bottlers, and wholesalers remit what they owe.
Is there a credit check? The application collects no credit information at the standard amount, and most applications approve instantly. If a check ever runs for a larger amount, it is a soft pull that never affects your credit score.
Who sets my exact amount? The ABC Authority, based on your volume of business, within the $1,000–$100,000 statutory range. If your volume changes, your required amount can change too. Confirm the figure on your ABC application and we issue it.
Where do I file it?With the Virginia ABC Authority, alongside your malt beverage license. We issue the executed bond ready to submit.
