What the bond actually guarantees

Utah's Department of Alcoholic Beverage Services (DABS) licenses retail alcohol operations under the Alcoholic Beverage Control Act (Title 32B), and conditions a resort liquor license on a surety bond. The bond is a compliance-and-tax guarantee: it stands behind your faithful compliance with Title 32B and the rules and directives of the Alcoholic Beverage Control Commission.

It's a three-party arrangement: you (the principal), the surety carrier standing behind you, and the State of Utah (the obligee). If a licensee violates the alcohol-control laws or fails to pay amounts owed, the state can recover against the bond up to the surety's limit.

It is not insurance for you — if the surety pays a claim, you repay the surety. The bond is one line item on a larger DABS packet that also includes application and license fees set by the state.

Utah Code Title 32B (Alcoholic Beverage Control Act)Utah's Alcoholic Beverage Control Act (Title 32B) authorizes DABS and the Alcoholic Beverage Control Commission to require a surety bond as a condition of a retail license. No. You pay $750 — the flat 3% of the bond amount. The $25,000 is the surety's maximum liability to the state; it's not a deposit, and nobody holds your money.
