What the bond actually guarantees
TDHCA’s Manufactured Housing Division regulates the industry under the Texas Manufactured Housing Standards Act (Occupations Code Chapter 1201). Anyone working as a manufacturer, retailer, broker, installer, or salesperson must be licensed, and a manufacturer, retailer, broker, or installer license requires a surety bond on Form 1025 — the Continuous Manufactured Housing Licensing Surety Bond.
The bond is payable to the manufactured homeowner consumer claims program. It protects buyers from loss due to a licensee’s fraud, misrepresentation, or failure to meet its obligations under Chapter 1201 and the TDHCA rules — covering restitution a licensee fails to pay.
TDHCA’s Manufactured Housing Division also acts as HUD’s state supervisory agent under the National Manufactured Housing Construction and Safety Standards Act, and under its agreement with HUD performs post-production monitoring of HUD-Code homes produced in or shipped to Texas — a manufacturer covered by that arrangement is still a licensed manufacturer under Chapter 1201 and still posts the licensing security. The amount is set by §1201.106 by license type: $100,000 manufacturer, $50,000 retailer, $50,000 broker, $25,000 installer (a manufacturer with no licensed in-state plant or facility for warranty service and repairs files an additional $100,000). If the surety pays, you repay the surety.
