The City of La Porte's Code of Ordinances, Chapter 82 (Buildings and Building Regulations), Article X ('Earth Removal'), requires a special permit before excavating for gravel, sand, stone, rock, or earth inside the city — issued by the city council only after a public hearing, with notice published for three consecutive weeks in a local newspaper. Under Section 82-597, the city will not issue that permit until the applicant files a $25,000 surety bond with the City Secretary.
It's a three-party arrangement: you (the principal), the surety carrier, and the City of La Porte (the obligee). The bond indemnifies the city for any loss, liability, or damage arising from the making, existence, or manner of guarding or constructing the excavation — the surety on it must be a corporation licensed to do business in Texas.
It is not insurance for you — if the surety pays a claim, you repay the surety. This is a different permit from La Porte's routine right-of-way permit, which the city issues for street cuts and utility work without requiring a bond at all — the $25,000 bond applies specifically to the earth-removal permit under Article X.
