What the testing provider bond actually covers

Texas lets approved third-party providers administer the commercial driver license skills test on behalf of the Department of Public Safety, under Transportation Code § 522.023 and the rules in 37 Texas Administrative Code § 16.31. A provider must be licensed by DPS and post a surety bond as a condition of approval.

The bond is $25,000 for each examiner the provider employs, so it scales with the size of your testing operation. It guarantees that DPS can promptly pay the reasonable expense of re-testing drivers if the provider or one of its examiners is involved in fraudulent skills-testing activity.

Code § 522.023 (37 TAC § 16.31)Texas Transportation Code § 522.023(d) lets the Department of Public Safety authorize a third party to administer the commercial driver license skills test, and 37 Texas Administrative Code § 16.31 sets the terms: unless it is a governmental agency, an authorized organization must secure and maintain a continuous security bond in the principal sum of $25,000 per examiner, sufficient to pay for re-testing drivers if the organization or an examiner is involved in fraudulent testing activity.
